Purpose of the Terms and Conditions
1.1. By making a purchase on Action Yachts, you enter into a contract with Action Yachts. These General Terms and Conditions (GTC) define the content of this contract.
1.2. Additional information about Action Yachts can be found in the About Us section.
Agreement with Terms and Conditions
1.3. By placing an order (e.g., clicking the button to complete the order), you accept these GTC as binding. The terms also include the Complaint Policy, Privacy Policy, Shipping Methods, and other referenced documents.
Which Parts of the GTC Are Binding and Which Are Illustrative?
1.4. At the beginning of selected chapters or complex sections of the GTC, we provide a summary of key points. These summaries are in italics (in info boxes) and serve only as guidance; they are not legally binding.
1.5. Numbered paragraphs, on the other hand, are legally binding.
2. How to Shop at Action Yachts
Shopping via the E-Shop
2.1. You can shop at www.jetblade.eu.
2.2. Your order is created once you click the button to complete the purchase. Until then, you can freely modify the order, including shipping and payment methods.
2.3. The contract is concluded when we confirm your order. Confirmation will be sent to your selected email address, so please ensure that your information is correct. The confirmation email will include these GTC and the Complaint Policy.
2.4. Subsequent changes to an order are only possible upon mutual agreement, under legal conditions, or as specified in these GTC.
2.5. Orders through the e-shop www.jetblade.eu can be placed 24/7.
2.6. While we strive to maintain uninterrupted e-shop availability, unexpected outages may occur. In cases of system failures or force majeure (e.g., power outages), we are not responsible for service disruptions.
Shopping at a Physical Store or via Email
2.7. You can also order through an Action Yachts representative at any branch, via phone or email, found in the About Us section.
2.8. When ordering via email, the contract is formed once you receive an order confirmation email. When ordering by phone, the contract is concluded upon your confirmation. If placing an order through an Action Yachts representative, the contract is binding once payment is made (even partially).
2.9. Physical store locations are open during their designated business hours, available here.
2.10. Action Yachts retains ownership rights over purchased goods until full payment is received.
3. Special Cases: Pre-Orders, Orders Over €10,000, and Specific Items
3.1. The following exceptions apply to:
- Pre-orders
- Orders exceeding €10,000
- Purchases of certain item types (e.g., footwear, motor vehicles, vouchers, digital content)
3.2. Pre-orders only reserve a spot on the waiting list, not a purchase contract. We cannot control delivery timelines for pre-ordered goods. The contract is formed once you are notified that the item is available for you. Pricing information for pre-orders is available below.
3.3. For orders exceeding €10,000, you must log into your user account, which must have previously been used for a successful purchase contract with Action Yachts. If this condition is not met, Action Yachts may cancel the order and refuse to enter into a contract.
3.4. To minimize financial risks, Action Yachts requires payment before dispatching high-value goods.
3.5. When purchasing footwear, we recommend measuring your foot size carefully. Try on new shoes indoors with clean socks to maintain their condition.
3.6. If returning footwear within 14 days, ensure they are clean, unworn, and in their original box, as they would be in a physical store.
3.7. If the footwear shows signs of wear, we may reduce the refund amount to cover depreciation costs. This may include cleaning or repair costs, and in some cases, the entire purchase price may be non-refundable.
3.8. Third-party vouchers: Action Yachts acts only as a reseller. For voucher claims, contact the provider listed on the voucher or the product description in our e-shop.
3.9. Upon purchasing a voucher, a unique redemption code will be sent to your email. Use this code with the respective provider for services or goods.
3.10. You can cancel a voucher if it has not been redeemed. For product/service complaints, we recommend contacting the voucher provider for faster resolution.
3.11. Gift vouchers from Action Yachts are subject to separate terms outlined on the voucher.
3.12. Purchases and website access for efoils are restricted to persons over 18 years old.
3.13. Upon receiving an efoil, Action Yachts or the courier may request an ID check to verify the recipient's age. Failure to verify age may result in order cancellation.
3.14. Digital Content Usage: All digital content purchased from Action Yachts must comply with:
- GTC and applicable copyright laws
- The software's licensing terms (e.g., EULA)
3.15. Digital content may only be used for personal purposes, unless stated otherwise in licensing terms.
3.16. Copying or distributing digital content in violation of licensing agreements is prohibited. Unauthorized use may result in content access restrictions.
3.17. Items with Digital Features (e.g., smartphones, laptops, smart TVs) receive updates from the manufacturer for an expected period (typically 5 years but may vary).
3.18. Electronic content gifted by Action Yachts is subject to these terms.
3.19. Vehicle/Boat Purchases: Contracts for motor vehicles or boats must be completed in person at an Action Yachts location.
3.20. Vehicle reservations may require a refundable deposit, deducted from the purchase price. If the purchase is canceled, the deposit is refunded within 7 days.
3.21. You officially own the vehicle/boat once full payment is made and the handover protocol is signed.
3.22. If a vehicle is registered before canceling the purchase, Action Yachts may deduct up to 30% of the purchase price for depreciation costs.
Customers who enter their company identification number (IČO) in their user account, i.e., legal entities and self-employed individuals (entrepreneurs, including public sector customers), are automatically enrolled in the Action Yachts for Business program. As a member of the Action Yachts for Business program, the entrepreneur gains access to a preferential price list and special discounts for business customers. Action Yachts also allows entrepreneurs to shop with the same benefits as consumers, including the option to return purchased goods within 14 days (see Article VII of these Terms and Conditions) and a two-year warranty on goods (see the Complaints Policy).
3.23. Preferential Price Lists
Entrepreneurs enrolled in the Action Yachts for Business program are offered special preferential price lists by Action Yachts, based on their turnover (the total value of purchases made by the entrepreneur excluding VAT on the e-shop www.jetblade.eu, calculated for the last 12 months from today's date). The price lists include:
- BASIC for all members of the Action Yachts for Business program,
- BRONZE for entrepreneurs with a turnover exceeding EUR 50,000,
- SILVER for entrepreneurs with a turnover exceeding EUR 250,000,
- GOLD for entrepreneurs with a turnover exceeding EUR 1,000,000.
Action Yachts reserves the right not to provide a preferential price list to an entrepreneur, to change the price of goods within the preferential price lists, and to modify the list of goods offered within the preferential price lists. Action Yachts warns that prices within the preferential price list may change continuously and that such price changes do not entitle the entrepreneur to claim the price difference.
Action Yachts also reserves the right to grant a preferential price list to an entrepreneur even if they do not meet the turnover condition. Action Yachts will notify the entrepreneur via email upon activation of the preferential price list. Therefore, Action Yachts recommends that members of the Action Yachts for Business program enable marketing communication.
3.24. Trial Purchase
Members of the Action Yachts for Business program from the public sector, particularly schools and state institutions, are allowed a trial purchase by Action Yachts. These members, upon prior agreement with Action Yachts, can try out goods (approve the goods) within a 14-day trial period from the date of order creation. If the member rejects the goods within the trial period, they must return them by the end of the trial period; otherwise, they commit to paying the purchase price of the goods. If the tested goods are damaged, the member must compensate Action Yachts for the damage.
3.25. Invoice with Deferred Payment
Entrepreneurs whose turnover in each of the last three calendar months is at least EUR 50,000 may be eligible for deferred payment of the purchase price, offered by Action Yachts. Entrepreneurs can request this payment option via email at info@actionyachts.eu. Detailed information is available here. Action Yachts reserves the right to deny or cancel the option of deferred payment at any time. If an entrepreneur delays the payment of an invoice (purchase price), Action Yachts may transfer or assign the claim to a third party for collection.
4. Delivery Options
4.1. Delivery methods, conditions, and prices are available here.
4.2. Once the contract is concluded, Action Yachts will deliver the selected goods using the chosen delivery method, and the customer must enable the delivery and accept the goods. Along with the goods, Action Yachts will provide other relevant documents. If you selected delivery to an address or a pickup point of one of our transport partners, Action Yachts will hand over the goods to the carrier, who will ensure delivery in the specified time frame. Until the goods are delivered and handed over to you, or until you refuse to accept the goods, the risk of damage to the goods remains with Action Yachts.
4.3. You will be informed about the estimated delivery time and other details regarding your chosen delivery method via your provided email address. The estimated delivery time may change depending on the logistical capabilities of Action Yachts and/or its carriers, and you will be promptly informed of any changes. In the event of force majeure or an IT system failure, Action Yachts is not responsible for delayed delivery.
4.4. Upon receiving the goods, you should check that you have received the correct quantity of goods as ordered. Additionally, inspect the package for any visible damage, dents, or deformations. If the package is damaged, you have the right to refuse the goods or accept them and record the condition in the delivery protocol with the carrier. You should then send the protocol along with a description of the damage via email to info@actionyachts.eu, or by fax or mail to the address listed in the "About Us" section.
4.5. If you have paid for your goods online in advance, you must verify your identity with a PIN code in the following cases:
- When picking up an order from an Action Yachts Box,
- When collecting an order from a branch,
- When receiving an Action Yachts Express order,
- Depending on the chosen carrier and their transport conditions.
This PIN code will be sent to the phone number provided in your order. Additionally, Action Yachts or the carrier may require you to present an ID card or passport or request your signature instead of the PIN code upon delivery. If you do not provide the required verification, the goods may not be handed over.
4.6. If you are purchasing as a legal entity, the goods will be handed over only to:
- The statutory representative of the legal entity,
- A person with a certified power of attorney, or
- A person listed as a "manager" in the profile on www.jetblade.eu who can also present an identity document.
4.7. Goods purchased by a self-employed individual will be handed over only upon presentation of a valid identity document.
4.8. If you are a VAT payer at the time of purchase, do not collect the goods in person at a branch, and the goods are invoiced with a 0% VAT rate, the place of delivery must be the address of the registered office or business premises listed in the commercial, trade, or similar registry.
4.9. If you refuse to accept the goods at the time of delivery, you have an additional period to collect them. If you do not collect the goods within this additional period, the contract is automatically terminated.
4.10. For digital content purchases, delivery occurs when you receive an email from Action Yachts containing a download link or when the link is made available in your user account on www.jetblade.eu. The download link is valid for 60 days.
4.11. If you receive a larger quantity of goods than you ordered, you have the option to refuse the surplus. If you do not refuse it, the purchase contract is considered concluded for the additional goods, and you must pay for them.
4.12. Goods from Action Yachts Boxes can be collected 24/7, except for boxes located in facilities with specific opening hours (e.g., shopping malls) or in the event of system outages.
5. Complaints or What to Do in Case of Faulty Goods
5.1. All terms and procedures for complaints regarding goods are governed by the Complaints Policy, which is an integral part of these Terms and Conditions.
5.2. If you sell or gift the purchased goods (or otherwise transfer ownership of the goods), both you and the new owner must inform us. If you do not do so, we will treat you as the original purchaser and the owner of the goods (for example, we will handle complaints with you and, in the case of a refund, return the money to you).
6. Withdrawal from the Contract
6.1. In the case of withdrawal from the contract regarding a device containing your personal data, we recommend that you back up your data and delete it from the device (if possible).
6.2. Information on how to receive a refund in case of withdrawal from the contract is provided below.
I am a consumer
As a consumer, you have the right to return goods within 14 days if you purchased them remotely, for example, via the www.ActionYachts.cz online store. In such a case, you must return the goods undamaged, unspoiled, and without signs of use. You should try and inspect the goods in the same way as you would in a physical store. If the goods show signs of wear or other usage, we may reduce the refund by the value decrease resulting from such treatment.You cannot withdraw from the contract, for example, for hygiene products that were delivered in a sealed package and you have removed them from the package, for newspapers, periodicals, or magazines, and also for goods that have been customized based on your request. Additional cases in which withdrawal from the contract is not possible are listed below.

6.3. If you are a consumer (i.e., it is not an order “on behalf of a company,” or an order in which you provided your company ID), you have the right to withdraw from the contract and request a refund within fourteen days.
- In the case of a purchase agreement, the 14-day period begins from the day you take possession of the goods.
- In the case of an agreement for several types of goods or the delivery of multiple items, the 14-day period begins from the day you take possession of the last delivery of goods.
- In the case of repeated deliveries of goods, the 14-day period begins from the day you take possession of the first delivery of goods.
6.3.A) If you decide to withdraw from the contract and return goods that you have opened and used in a way other than what is necessary to familiarize yourself with their nature, properties, and functionality, the refund may be reduced. This applies, for example, to new LEGO sets that you have opened and started assembling. The percentage reduction of the refund depends on the condition of the goods and their resale potential. This is in accordance with § 1833 of the Civil Code.
How can you withdraw from the contract?
6.4. The methods of withdrawal are listed according to speed of processing and your convenience:
- The recommended option for withdrawing from the contract is via your customer account in the Complaints and Returns section (also works in the mobile app), or through a kiosk at our branch. Withdrawals made this way are processed the fastest due to direct integration with our systems.
- You can also conveniently withdraw via Action YachtsBoxes. Current conditions for returning goods via Action YachtsBox after withdrawing from the contract or while processing complaints can be found here. Please read these conditions before returning goods in an Action YachtsBox.
- You can withdraw from the contract by filling out and submitting the sample form on our website.
- Lastly, you can withdraw from the contract through a sales consultant at our branch.

How and When You Must Return Goods
6.5. Once you withdraw from the contract, you must return the goods to us without undue delay, and no later than 14 days from the withdrawal itself. You return the goods at your own expense, and these costs will not be reimbursed. The goods should be undamaged, unused, and clean, including all accessories you received with them. If possible, the goods should be returned in their original packaging.
When You Cannot Withdraw from the Contract
6.6. If the goods are consumable or hygienic products, you can only withdraw from the contract if the original packaging has not been damaged, or if the other hygienic packaging protecting the goods has not been opened. This applies, for example, to personal care products, cosmetics, etc.
6.7. You also cannot withdraw from the contract if services have been provided for a fee, and these services were provided within 14 days of ordering. For example, if we perform installation of an appliance with your explicit consent. Another case where you cannot withdraw from the contract is for goods that we have modified based on your personal request.
6.9. If the goods are subject to rapid deterioration or have a short shelf life, or if they have been irreversibly mixed with other goods after delivery.
6.10. In the case of medicinal products.
6.11. In the case of repair or maintenance at a location you have specified at your request. This typically applies to cases like the repair of home appliances.
6.12. In the case of audio or video recordings or computer programs that were delivered in a sealed package, and you have broken the seal.
6.13. In the case of the delivery of newspapers, periodicals, or magazines, except for subscriptions.
6.14. You cannot withdraw with regard to the transportation of goods itself, as it is arranged for a specific period.
6.15. In the case of the delivery of digital content for a fee. A typical example of digital content is licenses for computer software (e.g., Windows), digital keys for computer games, or e-books. When ordering digital content, you acknowledge that you cannot withdraw from such a contract due to its nature, as the digital content will be made available to you for immediate download and use. This does not affect your right to withdraw from the contract for other goods purchased together with the digital content, provided their nature allows for it (e.g., if you purchased an e-book and a printed book, you can still return the printed book within 14 days).
What if You Return Damaged, Scratched, or Otherwise Worn Goods?
6.16. If you return goods that are damaged, scratched, or show other signs of wear, we may reduce the refunded purchase price by the amount corresponding to the wear or damage. For example, returning a scratched phone, a dented monitor screen, or a speaker covered in dirt. In such cases, the damage will be assessed, and your refunded price will be reduced accordingly.
How Will We Refund Your Money?
6.17. The money will be refunded to you within 14 days from the withdrawal from the contract in the same manner as the payment was made. However, we are not required to refund the money before you return the goods or prove that you have sent the goods or placed them in the Action YachtsBox. You also have the right to get a refund for the delivery costs of the goods, but only to the extent of the cheapest available delivery option on Action Yachts.cz.
6.18. If payment was made in cash, Action Yachts may require you to present identification, such as an ID card or passport, to prevent damage and avoid money laundering. If you fail to provide such identification, we may refuse to refund the money.
What if the Goods Included Gifts?
6.19. If you received gifts from Action Yachts in connection with the purchase of goods, and you have exercised your right to withdraw from the contract within 14 days, you must also return the gifts along with the goods.
6.20. In the case of withdrawal from a service contract, and if such service has already started, you are still required to pay us the proportional part of the price for the service already provided.
What if I Got a Discount on Another Product with My Purchase?
6.21. If you buy a main product (e.g., an efoil) and simultaneously use a discount linked to the main product (e.g., a 50% discount on a charger), this discount is conditioned on you keeping the main product.
6.22. If you withdraw from the contract, you must also return the discounted goods, i.e., both the efoil and the charger. If you fail to do so, the value of the discount will be deducted from the amount refunded for the main product.

I am an entrepreneur
When purchasing as an entrepreneur (i.e., with a business registration number), you do not have the legal right to return the goods within 14 days for distance purchases, unlike a consumer. The law only favors consumers in this regard.
However, we allow entrepreneurs to cancel the contract under the same conditions as consumers. Therefore, if you made the purchase as an entrepreneur, you can withdraw from the purchase within 14 days according to the rules mentioned above.
6.23. In the case of withdrawal from the contract, the same rules apply to you as an entrepreneur as they do for a consumer. These rules are outlined above in this section 6 "Withdrawal from the contract."
6.24. To protect your rights and prevent criminal activity, if you purchased as a legal entity and wish to redeem the issued credit note in cash directly at the Action Yachts branch, the amount will only be refunded to persons authorized to act on behalf of the respective legal entity. Such persons are those as defined in paragraph 4.6.
When can Action Yachts withdraw from the contract?
In certain cases, we also have the right to withdraw from the contract. This is especially the case when there is a pricing error, where the price is clearly disproportionate. Another case could be if the purchase or sale of an alcoholic beverage was made by a person under 18 years of age. We may also withdraw if you order goods that are intended only for a specific group of customers, e.g., only for schools.
Withdrawal by Action Yachts in case of pricing error
6.25. In the case of a pricing error, as described in Chapter 8 of these Terms and Conditions, Action Yachts has the right to withdraw from the contract. In this case, Action Yachts will cancel the order or provide another form of notification, making it clear that Action Yachts is withdrawing from the contract.
6.26. If you have already paid part of the purchase price for the goods, that amount will be refunded to you in the same manner within 14 days from the day following the withdrawal from the contract by Action Yachts.
6.27. Please note that some goods may be available only to a specific group of customers. In such cases, the information will be clearly and understandably indicated on the product or its description. If you order goods and do not belong to that specific group of customers, Action Yachts has the right to withdraw from the contract. This applies especially to products intended only for entrepreneurs, which are meant only for end users and cannot be further distributed.
Withdrawal by Action Yachts due to supplier's reasons
6.28. For goods marked as "in stock with the supplier," Action Yachts has the right to withdraw from the contract if the supplier withdraws from the contract (usually due to the unavailability of the goods on the supplier's side).
7. Complaints or How to Resolve Disputes with Action Yachts
7.1. We care about your satisfaction with Action Yachts. And if something goes wrong, we will face the situation head-on. Even though the customer is our top priority, we unfortunately cannot rule out the possibility of a rare mistake made by one of our employees, no matter how well we strive to operate. To resolve your complaint as quickly as possible, we have an internal process in place that allows us to review customer complaints promptly.

If we do not resolve your complaint to your satisfaction, these disputes can also be resolved out of court. In this case, as a consumer (if it is not a purchase made under a business registration number), you can contact an out-of-court dispute resolution body.
8. Payment, Refunds, and Billing Information
8.1. You can pay via the following methods on our e-shop. You can also choose to pay with cryptocurrency (e.g., Bitcoin), if Action Yachts allows it. If you later request a refund of the purchase price for this goods for any reason, the price can only be refunded in the currency listed on the invoice for this item (usually in EUR) and in the amount specified on the invoice. Any fluctuations in the exchange rate of the cryptocurrency will not be taken into account when refunding the purchase price, and by proceeding with the payment, you agree to this.
8.2. Until the full payment of the purchase price is made, the goods remain the property of Action Yachts (so-called retention of title).
8.3. Unfortunately, billing information cannot be changed after the order has been submitted.
8.4. Refund of VAT for persons from third countries upon export of goods will be done non-cash to the customer’s account, provided the conditions of the VAT law are met, unless Action Yachts decides on another method of payment. The preference for non-cash payment is due not only to legislation restricting cash payments but also to minimizing the risk of money laundering.
Refunds upon Withdrawal from the Contract
8.5. If you withdraw from the contract or if money is refunded for another reason, we will return the money in the same way that we received it from you. However, if it is not possible to return the money in the same manner, for example, if you paid in cash at the branch, to the courier, or if your payment card has expired, you are responsible for providing us with the correct details for the refund. You are also responsible for the accuracy of the details in cases where we agree to refund you in another way.
9. Prices
All our prices are final, in EUR, and include VAT. The price of the goods does not include shipping costs and any potential cash on delivery fees, which will be displayed only in the final stage of the "cart" based on your selection. Prices are rounded to the nearest whole EUR. There may be situations where, when ordering a larger number of items, the final price will differ slightly from the initially stated price. This can be due to the rounding of prices.
If there is abuse of information (personal or business details) or payment card data during the order, we may declare such an order invalid.
Suspiciously Low Price? Or Errors in Product Pricing
All prices we state are final and rounded to the nearest EUR. However, in rare cases, there may be a pricing error in the goods or services (although we take every measure to prevent this, we unfortunately cannot entirely eliminate the possibility, as our employees are also human). Details about errors in pricing, including when Action Yachts may withdraw from such a contract, are listed below.
9.1. There may be cases where the price of goods is listed incorrectly. These cases include, but are not limited to:
- The price of the goods is clearly incorrect at first glance (e.g., it deviates significantly from the usual price of the goods),
- The price of related services such as shipping, insurance, extended warranties, etc., is clearly incorrect,
- The price of the goods is missing or has one or more digits missing or incorrect, or
- A discount on goods exceeds 50%, unless the goods are part of a special marketing or clearance promotion.
9.2. In these cases, Action Yachts reserves the right not to conclude the contract, or to withdraw from such a contract even after you have received an email confirming the order. We must inform you of this step without delay.
9.3. If the discount on the goods is 80% or more, we recommend you verify whether there was a pricing error. This step helps us avoid potential disputes and discrepancies.
9.4. If you are unsure whether the price is incorrect, please contact us before making the purchase.
Use of Vouchers in Violation of Terms
If you use a discount or similar voucher in violation of its terms, we may declare such a contract invalid based on the conditions described below.
9.5. A contract may be declared invalid if there has been unauthorized use of a discount or similar voucher in violation of its terms. Unauthorized use may include:
- Using a voucher on goods it is not intended for,
- Using the voucher on a purchase that does not meet the minimum required value, or
- Action Yachts discovers that the discount voucher has already been used.
9.6. Unless stated otherwise, individual vouchers cannot be combined.
Pre-Order Pricing and Delivery Date
For pre-orders, please consider the price and delivery date as tentative!
In the case of pre-orders, the price listed is only provisional and may differ from the final price. Unfortunately, we cannot always guarantee a specific delivery date, but we will inform you in advance of any new developments. More details can be found below.
9.7. For goods you have pre-ordered, the price of such goods is provisional. The final price of the goods may differ. Action Yachts will inform you of any price change. The purchase price will be set after the goods are stocked by Action Yachts. Any difference between the paid provisional order and the final price will be refunded to you, or you will need to pay the difference before delivery. If the final price is not acceptable to you, we can cancel the pre-order.
9.8. Action Yachts reserves the right to change the delivery date for pre-order items, even multiple times. In case of a significant change in the delivery date (i.e., by more than 14 days), you have the right to withdraw from the contract. If the circumstances on which Action Yachts relied at the time of your pre-order have changed to the extent that it is unreasonable to expect Action Yachts to be bound by the pre-order, Action Yachts has the right to cancel the pre-order without further obligation and inform you accordingly.
How We Calculate Discounts
9.9. The original price (typically shown on the website with a strike-through as part of a discount notice) means the lowest price offered by Action Yachts for the specific item/service/license in the last 30 days before the discount. The calculation of the original price does not take into account individual pricing advantages and discounts that are not included directly in the current selling price of the goods (i.e., not automatically and universally applied). This original price remains valid even if the goods are discounted multiple times in a short time frame, but for no longer than 90 days.
9.10. Promotional prices are valid until stock runs out at Action Yachts. When the remaining stock is displayed, the promotion will end either when the stock is sold out or when the promotion period ends, whichever comes first.
9.11. If the goods were purchased from a non-VAT payer (typically a consumer), and these goods are later listed in categories such as "opened," "used," or "like new," we will list the price excluding VAT in accordance with the law. This may be reflected in the final invoice.
9.12. If you reach a certain purchase turnover, a lower purchase price may be displayed on our e-shop for certain goods compared to a non-logged-in user.
Student Program at Action Yachts
Action Yachts offers its registered users who are students and hold an ISIC/ITIC card (hereinafter referred to as "student") the opportunity to register for the Action Yachts student program and access the benefits described below. More details can be found here.
9.13. To activate membership, students must register by entering their ISIC/ITIC card number either in the user profile "My Action Yachts" in the account settings or in the last step of the order in the "Delivery Information" section. Each ISIC/ITIC card can only be registered to one user account on the Action Yachts e-shop. The name and surname on the card must match the account under which it is registered.
9.14. The validity of the ISIC card is verified with each purchase made by a student. If the card expires, we reserve the right to automatically remove it from the registered user account—student. This automatic removal cancels the student's membership in the student program, and you will not be informed by Action Yachts about this fact.
9.15. As part of the student program, students receive a discounted "student" price on selected items on the Action Yachts e-shop. Student prices are shown on the Action Yachts website for each product that qualifies for the student price. These products are not graphically separated or marked from those that do not qualify for a student discount. The list of discounted products according to the student pricing schedule is periodically updated by Action Yachts.
9.16. Another benefit of registering in the student program is occasional promotions (discounts) on selected brands, categories, or groups of goods. These discounts are available in the "Action Yachts for Students" section at this address. These discounts are only valid for a limited time, which is indicated on the product page.
9.17. Discounted prices and promotions are shown only to logged-in users with a valid registered ISIC card (students) and are automatically applied when the items are added to the cart.
10. Security and Data Protection
10.1. For the protection and processing of your data as a buyer by Action Yachts, the following Privacy Policy applies.
10.2. On the other hand, you as the buyer must protect your login credentials (particularly passwords) and not share them with anyone. Action Yachts is not responsible for any misuse of your login name or password by others. Additionally, you are not allowed to use another customer’s account, name, or password.
11. Reporting Illegal Content
11.1. Digital services are entering a new era in connection with new European Union regulations regarding the digital sector. Action Yachts responds to these changes with a series of measures and procedures that meet and exceed the standards set by this regulation. The security of our online store is one of our highest priorities. Therefore, we have implemented a reporting mechanism for illegal content uploaded by third parties, such as customer reviews. The single contact point tool allows users to actively participate in the protection and security of our online store and facilitates communication between us, our customers, partners, and regulatory bodies. All your questions, concerns, and feedback will be quickly and efficiently addressed.
11.2. We have implemented high standards of transparency and information about moderation. For example, in the case of user reviews, everything is thoroughly explained on this page, including the review approval process. We are happy to explain how content moderation works if needed.
11.3. We have committed to regularly publishing reports on content moderation. These reports, published annually, provide information about the number of reports of illegal content submitted through the mechanism outlined in Article 10 of these Terms, the measures taken based on these reports, and provide a generally transparent view of how we handle issues such as account suspensions and other aspects of content moderation. Additionally, every six months, we publish the number of active users.
11.4. In cooperation with regulatory bodies, we ensure compliance with applicable regulations if we are required to provide information about users. We collaborate with relevant government authorities and inform affected users about these processes, thereby strengthening trust and transparency. Action Yachts also places special emphasis on protecting underage users. We have implemented measures, including age restrictions on certain products, to ensure a safe environment and tailored content for these users.
11.5. Users can also submit complaints about decisions related to the moderation of illegal content through the internal complaint process outlined in Article 6 of these Terms, including decisions to remove your review based on a report submitted by a third party via the illegal content reporting mechanism. Complaints can be submitted within six months of the relevant decision.
11.6. Finally, we address the issue of Dark Patterns (manipulative practices leading to unwanted purchases and the provision of personal data) and advertising transparency. All our marketing and advertising activities are designed to be clear, fair, transparent, and understandable for all users.
11.7. We are aware of the importance of innovation and continuous improvement in response to the changing digital environment. Our voluntary efforts to comply with the latest DSA regulations demonstrate our commitment to providing not only a safe but also an ethical and user-friendly environment. 12. Final Provisions
12.1. Any relationships and disputes arising from the contract will be governed exclusively by the laws of the Republic of Croatia and will be resolved by the competent courts in the Republic of Croatia. The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply in accordance with Article 6 of this Convention.
12.2. The contract is concluded in the Croatian language. If a translation of the contract is needed for the buyer's convenience, in case of a dispute regarding the interpretation of terms, the Croatian version of the contract will prevail.
12.3. The concluded contract is archived by Action Yachts in its internal system for at least three years from its conclusion, but no longer than the period required by applicable regulations, for the purpose of successful fulfillment of the contract. It will not be accessible to third parties. Action Yachts will provide the customer with access to the contract in justified cases. The technical steps involved in concluding the contract are clearly outlined in these Terms, where this process is described in detail.
12.4. If some chapters contain a brief summary for basic orientation followed by a more detailed text, in case of discrepancies, the more detailed text, usually starting with the heading "more information" or "further conditions," takes precedence.
12.5. The conditions of marketing campaigns are governed by the specific terms of the respective promotion. Ongoing campaigns can be found on the homepage at www.jetblade.eu. If no specific terms are available, the campaign is governed by the general terms listed on www.jetblade.eu.
12.6. You will receive a copy of these Terms, including the Complaints Procedure and tax documents, by email once you complete your purchase. Tax documents are also available in your user account in the "My Purchases" section, under "Purchased Goods."
12.7. These General Terms and Conditions, including their components, are effective as of 01.02.2025, and they replace the previous version of the Terms and Conditions and its components. They are available at the headquarters and operations of Action Yachts or electronically at www.jetblade.eu.
